The key argument by academic researchers concerning child porn is that arguments against viewing the images are "Spirit Possession" (SP) views. Namely, that the mere act of the "wrong" person viewing them is bad.
ReplyDeletePlease note: Police, attorneys, D.A., judges, and juries all view child porn and apparently no harm befalls them. I have heard it said there are FBI agents who have view 100,000's of images without doing them any harm. However, if a "bad" person views these same images somehow great harm is being done merely by viewing them. Somehow there's some sort of voodoo argument at work here; hence, the "Spirit Possession" argument: merely by looking at an image I am harming another person.
Please note: Almost all images are many years old and in some cases the individual whose image is depicted is dead. In this case, how is a dead person harmed by someone viewing an image of him when he was alive?
BTW: I'm not against the voodoo religion, but I do think the Roman Catholic/Jewish Supreme Court (7/9 members are Catholics) needs to get a lobotomy in order to think straight about this topic...

I don't 100% agree with the way this problem being handled myself.
To me, this is a sign a much greater problem, pornography addiction, that is taking over people's lives up to the point where they lose any common sense, and get in trouble with the law.
The reason I keep track of child pornography cases, is because this is the only form of pornography addiction that society seems to care about.
I believe that people who watch child pornography need to get treated, and all of the society needs to be educated on the effects of pornography before they cross the line.
First, I would say this: under no circumstances would I view any images that even might be considered "child porn." The consequences are so draconian compared to what possible harm has been done by viewing these images that one would have to be stupid to view them. Also, I don't trust people not to hack into my computer and find anything they might be looking for. Moreover, I don't trust people not to break-and- enter into my home just to see what they might find. Yes, I am completely paranoid!
ReplyDeleteSecondly, it seems as though the punishment for viewing images on-line is sometimes more harsher than any actual physical contact with a minor. As your blog shows, there are many cases in which viewing a few images can bring 10 years in federal prison, lifetime supervision, having to register as a sex offender for life, having a felony on one's record (means many job opportunities are lost), sex therapy after the prison sentence, prohibitions on where someone may live, disgraced before the community and sometimes even large fines and losing one's house/property. I wonder if the typical first-degree manslaughter conviction is as harsh!
Considering the above case of disproportionate punishment, I wonder if this is an example of functionally insanity by our "injustice" system, or is it just a moral evil? Maybe a little of both...Do judges really believe the crime of viewing images merits this level of punishment? Why not just give the death penalty to those who jaywalk or drop a piece of paper on the streets?
I guess if the prosecution of child porn cases were limited to those who: a) truly manufactured real child porn ( real children under the age 12 years of age actually engaged in sexual contact with an adult), or b) who purchased child porn involving recent material created to be distributed, then I would not have a problem with this. In reading over a few hundred cases, none of them match the above criteria. In fact, it's not even clear whether the images are computer-generated or not...
In conclusion, I hope the witch hunt and hysteria associated with child porn will stop before 10,000's of more lives are ruined.
